The AIRE Centre (Advice on Individual Rights in Europe), Amnesty International and the European Human Rights Advocacy Centre (EHRAC) consider that the participation of ‘civil society’ in the measures to ensure better implementation of the European Convention on Human Rights and the case-law of the European Court of Human Rights in each of the 46 Council of Europe Member States is essential. Experienced representatives of past and future applicants to the Court and that of civil society must also be part of the on-going discussions about the future of the European Court of Human Rights.

To this end, the organizations propose a series of recommendations that aim to ensure greater transparency and inclusion of applicants to the European Court of Human Rights and civil society in the process of supervision of implementation of judgments of the European Court of Human Rights and in the discussions about the future of the European Court of Human Rights.

These recommendations propose amendments to the Committee of Ministers Rules relating to their work in supervising the implementation of final judgments of the European Court of Human Rights and the terms of friendly settlements of cases. Recommendations are also made regarding procedures for the exercise of the new powers granted to the European Court of Human Rights, under Protocol 14 to the European Convention on Human Rights, to clarify the interpretation of a judgment and to consider whether a state has failed to take measures to abide by a final judgment of the court in a case to which it is a party.

In addition, the organizations urge the Committee of Ministers to ensure that there is adequate representation of both non-governmental organizations and lawyers who regularly represent applicants before the European Court of Human Rights on the “Group of Wise Persons” which is to be established to consider the issue of the long-term future of the European Court of Human Rights.
