  • The Centre for Family Law and Practice intervening in an important abduction case in the Supreme Court of the United States of America

The Centre is intervening in the case of CHAFIN in which the United States Supreme Court will decide whether a child who has been returned to the state of habitual residence in accordance with the 1980 Hague Child Abduction Convention is at risk of being re-returned in circumstances where an appeal is lodged after the child's return. The Centre is being represented on a pro bono basis by Timothy Scott QC of 29 Bedford Row, David Williams, and Jacqueline Renton, both of 4 Paper Buildings. The Centre is working with the Civitas Child Law Clinic at the Loyola Chicago School of Law on the intervention. The case raises issues which relate to the research work in which Professor Marilyn Freeman (co-director of the Centre) is involved regarding the effects of abduction, and the Centre looks forward to the clarification of the law in this area which impacts significantly on the question of child welfare.
